WESSEX BASKETBALL ASSOCIATION DISCIPLINARY PROCEDURES
|
1. Scope:
a. This procedure applies to all disciplinary matters occurring under the jurisdiction of the Wessex Area Basketball Association.
2. Purpose:
a. The purpose of this procedure is to ensure that all disciplinary matters occurring under the jurisdiction of the Wessex Area Basketball Association are dealt with in a timely and fair manner.
3. Definitions:
a. Disciplinary Committee:
1) The Disciplinary Committee is a sub-committee of the Wessex Area Basketball Association Committee.
2) The Disciplinary Committee will normally comprise the Technical Secretary, League Chairman and one other committee member. The quorum for this committee is three. Co-opted members may be used if committee members are unavailable or involved in the disciplinary incident.
3) The Disciplinary Committee will normally be chaired by the Technical Secretary.
b. Appeals Committee:
1) The Appeals Committee is a sub-committee of the Wessex Area Basketball Association Committee.
2) The Appeals Committee will normally comprise the Area Chairman and two other committee members. The quorum for this committee is three. Co-opted members may be used if committee members are unavailable or involved in the disciplinary incident. 3) The Appeals Committee will normally be chaired by the Area Chairman.
4) Committee members who served on the initial Disciplinary Committee may not sit on the subsequent Appeals Committee.
4. Procedure:
a. Disciplinary matters related to misconduct by Players, Coaches, Match Officials, Team Followers, Club Officials and other club members, occurring during or immediately prior to, or following matches under the jurisdiction of the Wessex Area Basketball Association will be considered by the Disciplinary Committee.
b. Clubs, players, coaches, match officials, club officials and other club members may be suspended for any matter as decided by Wessex Basketball.
c. In the event of a player, coach, substitute or team follower being disqualified from a match, the matter will automatically be considered by the Disciplinary Committee.
1) Each match official will be required to note on the reverse of the scoresheet that a disqualification has taken place, and submit a written report. The written report should be submitted on the Wessex Disciplinary Report Form. Match officials should not make any recommendations or comment, either in their report or otherwise, as to the disciplinary action they consider appropriate.
2) Each club and any individual may also submit written reports if they so choose.
3) The written reports must be submitted to the Wessex Area Administrator within 72 hours of the finish of the match in question.
4) The Disciplinary Committee will normally consider the incident(s) within 7 days of receiving the written reports.
d. The Disciplinary Committee will also consider other reports submitted in respect of any disciplinary matters not resulting from a disqualification.
e. A system of cumulative ‘penalty points’ will apply, and a one game suspension shall come into effect whenever a person’s total penalty points reaches (or exceeds) each of the following totals: 10, 15, 20, 25, 30, 35 etc.
f. A disqualification will automatically invoke the following penalty points. (Further penalty points may be awarded by the Disciplinary Committee as per section 4.7.)
1) A disqualifying foul will result in a minimum of 7 penalty points being awarded.
2) Player disqualifications, not arising from a disqualifying foul (e.g. 2 unsportsmanlike fouls), will result in a minimum of 5 penalty points being awarded.
3) Substitute, coach or team follower disqualifications, not arising from a disqualifying foul (e.g. 2 ‘C’ technical fouls), will result in a minimum of 7 penalty points being awarded.
g. The Disciplinary Committee will consider whether any additional penalty points should be added after consideration of the submitted reports.
h. All penalty points awarded (automatic or otherwise) do not come into effect until confirmed by the Disciplinary Committee.
1) All disciplinary penalty point’s cumulative totals shall revert to zero at the end of the season. The end of the season shall be deemed to be the day of the Wessex Cup Finals, with the following exceptions:
i) Any penalty points awarded on or after the 1st March will be carried forward until 31st December of the following season.
ii) If it deems it appropriate the Disciplinary Committee may determine that a cumulative points total will be held on record for a specific period of time (i.e. longer than the current season).
i. A person under suspension is barred from participating in any match under Wessex jurisdiction until such time as the suspension is served for the team from which the suspension arose.
5. Appeals:
a. Decisions of the Disciplinary Committee may be appealed to the Wessex Area Basketball Association Appeals Committee.
b. Appeals must be submitted in writing to the Wessex Administrator within 7 days of notification of the outcome of the Disciplinary Committee.
1) When submitting an appeal, the appellant must state the reason for the appeal.
2) A deposit of £50 must accompany any appeal.
c. The Appeals Committee shall have the authority to uphold or amend the original decision of the Disciplinary Committee.
d. The Appeals Committee shall have the authority to determine if all or part of the deposit is refundable. If it is determined that the deposit is partly refundable, the Appeals Committee have the authority to determine the portion of the deposit to be refunded.
e. Any further appeal should be to England Basketball, and will be dealt with according to EB procedures.
